2.1 Information You Provide Directly
When you sign up for our email list, SMS program, or Neon Tacos loyalty program, we may collect:

2.2 Information Collected Automatically
When you visit our website, we and our third-party service providers (including Klaviyo) may automatically collect:

•       IP address and general geographic location
•       Pages visited, links clicked, and time spent on our site
•       Referral source (how you arrived at our site)
•       Cart activity and browsing behavior tracked via Klaviyo's website tracking pixel and cookies
2.3 Information From Our Point-of-Sale System
When you dine at Uno Más, our Toast POS system may collect transaction data including order history and visit frequency. This data may be linked to your loyalty or marketing profile if you have opted in to the Neon Tacos program.
3. How We Use Your Information
We use the information we collect for the following purposes:
•       To send you email marketing communications about Uno Más promotions, events, menu updates, and Taco Tuesday specials (with your consent)
•       To send you SMS text message marketing about time-sensitive deals, events at the main restaurant and The Mezzanine, and loyalty program updates (with your express written consent)
•       To manage and operate the Neon Tacos loyalty program
•       To verify that subscribers receiving alcohol-related marketing are 21 years of age or older
•       To personalize communications based on your visit history and preferences
•       To improve our website, marketing programs, and overall guest experience
•       To comply with applicable legal obligations
4. Email Marketing & CAN-SPAM Compliance
By subscribing to our email list, you consent to receive periodic marketing emails from Uno Más Tacos & Tequila. We send approximately 2–4 emails per month, which may include promotions, event announcements, menu highlights, and Neon Tacos loyalty updates.
Every marketing email we send will include:

•       A clear and conspicuous unsubscribe link
•       A one-click unsubscribe option in the email header
You may unsubscribe from our email list at any time by clicking the "Unsubscribe" link in any email we send, or by contacting us at Tacos@unomastacoshop.com. We will process your opt-out request within 10 business days.
5. SMS Text Message Marketing & TCPA Compliance
5.1 SMS Consent
By providing your phone number and checking the SMS consent box on our sign-up form, you expressly consent to receive recurring automated marketing text messages from Uno Más Tacos & Tequila at the mobile number you provide. These messages may include promotions, event announcements, last-minute specials, and loyalty program updates.
Consent is NOT a condition of purchase or dining at Uno Más. You may still enjoy our restaurant and loyalty program without subscribing to SMS marketing.
5.2 Message Frequency & Rates
Message frequency varies. You may receive approximately 4–8 SMS messages per month. Message and data rates may apply depending on your mobile carrier and plan.
5.3 How to Opt Out of SMS
You may opt out of SMS marketing at any time by replying STOP to any message you receive from us. You may also opt out by:
•       Replying CANCEL, QUIT, END, UNSUBSCRIBE, or STOP to any text message
•       Emailing us at Tacos@unomastacoshop.com with your opt-out request
•       Calling us or visiting us in person at 2020 N Monroe St, Suite C, Spokane, WA
We will honor all opt-out requests within 10 business days regardless of the method used. After opting out, you may receive one final text message confirming your removal. You will not receive further marketing texts after that confirmation.

5.5 SMS Quiet Hours
We will only send SMS messages between 9:00 AM and 8:00 PM in your local time zone.
6. Alcohol Marketing — Age Verification & Compliance
6.1 Age Requirement for Alcohol-Related Marketing
Uno Más Tacos & Tequila is a full-service restaurant and tequila bar. Some of our marketing communications may include information about tequila, cocktails, happy hour specials, and other alcohol beverage promotions.
We do not knowingly direct alcohol-related marketing to individuals under 21 years of age. If you subscribe to our SMS or email list and may receive alcohol-related content, we require you to provide your date of birth (MM/DD/YYYY) to verify that you are of legal drinking age.
If we discover that a subscriber is under 21, we will promptly remove them from any marketing lists that include alcohol beverage content.
6.2 In-Store Age Verification
For any orders that include or may include alcohol products, age verification will be performed in person at 2020 N Monroe St, Suite C, Spokane, WA 99205 at the time of pickup or service. No alcohol products will be released without verification of valid government-issued identification confirming legal drinking age.
6.3 Food Items Prepared With Alcohol
Some menu items at Uno Más are prepared using alcoholic beverages as cooking ingredients (such as beer-braised or spirits-infused preparations). These items are classified as food products. While most alcohol content is removed during cooking, trace amounts may remain. If you have dietary concerns related to alcohol content in food, please inform your server.
Marketing of food items prepared with alcohol as a cooking ingredient is not considered alcohol beverage marketing and does not require age verification under current regulations. However, out of an abundance of caution, we maintain responsible marketing practices for all content related to our restaurant and bar.
 7. How We Share Your Information
We do not sell your personal information to third parties for their own marketing purposes.
We may share your information in the following limited circumstances:
•       Service Providers: We share data with Klaviyo, Inc., our email and SMS marketing platform, which processes data on our behalf. Klaviyo acts as a data processor and is bound by its data processing agreements. We may also share data with Toast, our point-of-sale system provider.
•       Opt-In / Consent Status: We may share your SMS or email opt-in consent status with our marketing platform providers and phone carriers as required to deliver messages compliantly. This data is used for service delivery only and is not shared for third-party marketing purposes.
•       Legal Requirements: We may disclose your information if required by law, court order, or government regulation, or to protect the rights and safety of Uno Más Tacos & Tequila, our guests, or the public.
•       Business Transfers: In the event of a merger, acquisition, or sale of substantially all of our assets, your information may be transferred as part of that transaction.
8. Cookies & Website Tracking
Our website uses cookies and similar tracking technologies to improve your experience and support our marketing programs. Klaviyo's tracking pixel may collect data about your website activity, including pages visited and items you interact with, to support email personalization and cart abandonment flows.
You can control cookie preferences through your browser settings. Disabling cookies may affect certain features of our website and marketing personalization. We do not currently respond to browser "Do Not Track" signals, but we respect your right to opt out of SMS and email marketing at any time as described in this policy.
9. Your Privacy Rights
You have the following rights regarding your personal information:
•       Right to Access: You may request a copy of the personal information we hold about you.
•       Right to Deletion: You may request that we delete your personal information from our marketing systems, subject to certain legal exceptions (such as retaining opt-out records to honor your preferences).
•       Right to Withdraw Consent: You may withdraw consent for email or SMS marketing at any time using the opt-out methods described in Sections 4 and 5.
•       Right to Correct: You may request correction of inaccurate personal information we hold about you.

10. Data Retention
We retain your personal information for as long as you remain subscribed to our marketing programs and for a reasonable period thereafter. Specifically:
•       SMS consent records are retained for a minimum of 4 years in accordance with TCPA statute of limitations requirements.
•       Suppression lists (records of individuals who have opted out) are retained indefinitely to ensure we honor your opt-out preferences.
•       Transaction and loyalty data may be retained for up to 5 years for operational and legal compliance purposes.
•       Do-not-contact lists are maintained for a minimum of 5 years.
11. Children's Privacy
Our website and marketing programs are not directed to individuals under the age of 13. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected information from a child under 13, please contact us immediately at Tacos@unomastacoshop.com and we will promptly delete such information.
As noted in Section 6, alcohol-related marketing is directed only to individuals who have verified they are 21 years of age or older.
12. Data Security
We implement reasonable administrative, technical, and physical safeguards to protect your personal information from unauthorized access, disclosure, alteration, or destruction. Our marketing data is processed through Klaviyo's platform, which maintains its own security certifications and safeguards.
No method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your personal information, we cannot guarantee absolute security.
Washington State data breach notification law (RCW 19.255) requires us to notify affected individuals within 30 calendar days of discovering a breach involving personal information. If a breach affects 500 or more Washington residents, we are also required to notify the Washington State Attorney General.
13. Washington State — My Health My Data Act Notice
Washington's My Health My Data Act (RCW 19.373) protects "consumer health data" — personal information linked to your physical or mental health status. For most guests, this law does not apply to the standard marketing data we collect (name, email, phone, purchase history).
However, if you share allergy information or dietary restriction data with us (for example, through a reservation system or in-person with staff), that information may qualify as consumer health data under the MHMDA. Mobile Terms of Service
The Uno Mas Taco Shop mobile message service (the "Service") is operated by Uno Mas Taco Shop   (“Uno Mas Taco Shop”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and   conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent   permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service   following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Uno Mas Taco Shop’s SMS/text messaging service, you agree to receive recurring SMS/text messages   from and on behalf of Uno Mas Taco Shop through your wireless provider to the mobile number you provided, even if   your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an   automatic telephone dialing system or other technology. Service-related messages may include   updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may   include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is   not a condition of any purchase with Uno Mas Taco Shop. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging   imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan   and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text   messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to +18444014904 or click   the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation   text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed   to other Uno Mas Taco Shop mobile message programs and wish to cancel, except where applicable law requires   otherwise, you will need to opt out separately from those programs by following the instructions provided in their   respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of   these changes. The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to   provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with   your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected   delivery of any information sent through the Service, any errors in such information, and/or any action you may or   may not take in reliance on the information or Service.
